Selecting an Attorney

Because an attorney describes himself or herself as a "Personal Injury Lawyer" in the Yellow Pages, on TV, or on the Internet, does not mean that he or she is highly skilled, experienced or successful in this field. Advertising is a marketing tool, not a resume of the lawyer’s actual qualifications. The representations made in advertising are not peer-reviewed, nor certified by State Bar. To determine if the lawyer you are considering has the necessary skill, knowledge and experience to handle your case, there are several things to take into account.

1. Ask those that should know. People will often ask their friends or family members if they know about this or that law firm or attorney. Usually, these persons will not be speaking from personal experience, but from what they may have heard or seen in advertising. Persons that have direct contact with the lawyer or firm in question, such as judges, doctors, and courtroom personnel are often good sources of information about a practicing attorney or firm. If you have access to these individuals, ask them if they know about the lawyer’s reputation? Is he or she considered one of the best? Is he or she well respected in the courtroom? Does he or she have the experience and resources to successfully handle your case? What results has the lawyer or firm obtained?

2. Review Accomplishments and Peer Review Based Assessments. Statements in advertising can be misleading. They are merely statements of the lawyer about himself or herself. However, peer reviewed assessments or acknowledgements found in industry accepted publications such as Martindale Hubbell or California Super Lawyers provide objective information about the attorney. In addition, certifications of specialties by the State Bar or other recognized certifying boards are an indication of the learned accomplishments of the attorney, and his length of experience in the field. Finally, membership in highly regarded professional organizations, particularly where the organization accepts membership by invitation or sponsorship only, and abides by certain high standards of qualifications, are a very good indication of the accomplishments that the attorney has obtained during his or her career.

3. Am I Confident that the Attorney is Working in My Interest? Lawyers, like doctors, should have good “bedside manners.” You should feel confident that the lawyer understands the nature of your injury or loss, and understands the type of treatment that you may be undergoing. You should feel that you can ask questions. You should feel confident when you receive an answer that the attorney has listened to you and understood your problem, and that you have received a sincere, honest and straightforward appraisal your circumstance. If you do not have confidence that is what you are receiving, you cannot be confident that the attorney is truly working in your interest.
